A Federal High Court sitting in Minna, Niger State, has adjourned its judgement on the case involving the enforcement of the fundamental human rights of one Mohammed Ahmadu from the Nikangbe Community in Chanchaga Local Government Area of the State.
The presiding Judge, Justice Aminu Garba, on Monday, adjourned the case to January 17, 2024.
The accused was allegedly said to have used the proceeds from his terrorism and kidnapping acts to build his house situated in Nikangbe, which was demolished in 2022.
Ahmadu and six others were arrested by security agencies, and since then, his whereabouts were not known. This prompted his wife, Hajiya Innawuro Mohammed Ahmadu, who was disturbed about the development, to approach the court through her counsel, Bar. Mohammed Tsado Mohammed, seeking redress.
Hence, Bar Mohammed filed a suit before a Minna Federal High Court, joining the Inspector General of Police, the Director General of the Department of State Service (DSS), the Niger State Government, and the state Ministry for Local Government and Chieftaincy Affairs in the suit.
The counsel prayed the court for intervention to enforce the rights of his client and to release him from the hold of security agencies or charge him to court for prosecution.
Bar Mohammed said, “Since his arrest and the demolition of his building in 2022, his whereabouts have not been disclosed, and the police and DSS claim that he was not in their custody.”
The counsel for the state government, the former Attorney General and Commissioner for Justice in Niger State, Barrister Nasara Dan Mallam, in response, said the state had no hands in the arrest of the defendant, as speculated by the counsel.
The presiding Justice Aminu Garba, while adjourning the matter, pleaded with both counsels for not delivering his judgement and adjourned it to January 17, 2024.
